1. Acceptance of Terms

By accessing or using Audiwise ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. We may update these terms from time to time, and continued use of the Service constitutes acceptance of any changes.

2. Service Description

Audiwise provides audio analysis and music production feedback. You upload audio tracks, and our system analyzes them using spectral analysis, loudness metering, and AI models to generate production feedback reports. The feedback is generated by AI and should be considered as suggestions, not professional engineering advice.

3. User Accounts

You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must provide accurate information when creating an account. You may not share your account with others or create multiple accounts. We reserve the right to suspend or terminate accounts that violate these terms.

4. Acceptable Use

You agree not to:

• Upload content that you do not own or have rights to.
• Use the Service for any illegal purpose or in violation of any applicable law.
• Attempt to reverse-engineer, decompile, or extract the underlying algorithms or models.
• Use automated tools to scrape, crawl, or extract data from the Service.
• Interfere with or disrupt the Service or its infrastructure.
• Upload malicious files or content designed to harm the Service or other users.

5. Intellectual Property

Your content: You retain all ownership rights to audio files you upload. By uploading, you grant us a limited, temporary license to process your audio solely for the purpose of generating your analysis report. This license ends when processing is complete and the file is deleted.

Our content: The Audiwise platform, including its design, code, algorithms, and branding, is owned by Audiwise. Analysis reports generated by the Service are provided for your personal use. You may share your reports using our sharing features.

6. Payment Terms

• Free tier users receive a limited number of analyses per month as specified on our pricing page.
• Paid subscriptions (Pro, Studio) are billed monthly or annually via Stripe. Prices are displayed on our pricing page.
• You may cancel your subscription at any time. Access continues until the end of the current billing period.
• One-off analysis credits are non-refundable once purchased.
• We reserve the right to change pricing with 30 days' notice to existing subscribers.

7. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. AI-generated feedback is algorithmic in nature and may not always be accurate or applicable to your specific use case. Audiwise is not a substitute for professional mixing, mastering, or audio engineering services. We do not guarantee any specific results from using our feedback.

8. Limitation of Liability

To the maximum extent permitted by law, Audiwise shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly. Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your access to the Service at our discretion if you violate these terms. You may delete your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately, and we may delete your data in accordance with our Privacy Policy.

10. Governing Law

These terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these terms or your use of the Service shall be resolved through good-faith negotiation before pursuing formal legal action.
